NYC didn't learn from London England

Leftist Muslim mayors = poorly run cities. After years of a downhill slide, New York City has decided to double down on the crazy leftist...crazy train:

Misdirected outrage

Here's some background  and then the rantings of BLM activist Hawk Newsome, who is reacting to the verdict of a man who was acting not in the interest of himself but of community protection.  While it is unfortunate that Jordan Neely died, Daniel Penny is not the problem here. What is the problem is the lack of mental health support for Jordan Neely after his mother was murdered. The criminal activity is the misuse of taxpayer funds. Jordan Neely needed help and the level of support is just not there because governments continue to fund stupid things instead of putting the money where it's needed. That is the real crime.

I am not without sympathy for Jordan Neely, he needed help and did not get it. So he spiraled. But convicting Daniel Penny would be yet another injustice perpetrated the government.

Al Sharpton also reacts, but not to the proposed vigilantism of Hawk Newsome, nor another story in New York (see below), but rather something he can grift from - racism in the verdict.  Really Al?

[Note this video continues on after the relevant section ends at roughly 2:54.

Here's something else to which Hawk Newsome was not reacting, a cold blooded assassination in the streets of New York. Luigi Mangione committed an outright assassination on the streets of New York. Where's the outrage on this? Regardless of how you might feel about big pharma, big insurance, big healthcare, assassinations are wrong. Period. Vigilante justice in the streets makes everyone unsafe instead of those suffering from mental health issues and the people they are threatening.

What Daniel Penny did was not vigilantism.  It was reacting to a real and imminent threat. Luigi Mangione was being a vigilante. That's what really needs to be prevented.

Adding to the debate fallout

Let's Go Brandon shot himself in the foot Achilles heel in the June presidential debate. The Democrats are desperate. I think they may sentence Trump in NY to prison time. They're truly desperate.  They need to shake things up.  They cannot do it successfully any other way so far. They don't have much ammo to use. They're bereft of ideas. Lawfare is one of the few things they have left. I think it's probably going to happen.

If it does it will be the biggest backfire in political history.

The list of flaws in the NY Trump felony conviction case

There's even more ridiculousness than what the Wall Street Journal lists below, but from a strictly legal standpoint, this is WAAAYYY more than enough to overturn this conviction:

...The state offense with which Mr. Trump was indicted, “falsifying business records,” requires proof of an “intent to defraud.” To elevate this misdemeanor to a felony, the statute requires proof of “intent to commit another crime.” In People v. Bloomfield (2006), the state’s highest court observed that “intent to commit another crime” is an indispensable element of the felony offense.

New York courts have concluded that the accused need not be convicted of the other crime since an “intent to commit” it is sufficient to satisfy the statute. But because that intent is, in the words of Winship, “a fact necessary to constitute the crime,” it is an element of felony falsification. Due process requires that the defendant receive timely notice of the other crime he allegedly intended to commit. It also requires that he have opportunity to defend against that accusation and that prosecutors prove beyond a reasonable doubt his intent to commit it.

Mr. Trump’s indictment didn’t specify the other crime he allegedly intended to commit. Prosecutors didn’t do so during the trial either. Only after the evidentiary phase of the trial did Judge Juan Merchan reveal that the other crime was Section 17-152 of New York’s election law, which makes it a misdemeanor to engage in a conspiracy “to promote or prevent the election of any person to a public office by unlawful means.”

To recap, the prosecution involved (1) a misdemeanor elevated to a felony based on an “intent to commit another crime,” (2) an indictment and trial that failed to specify, or present evidence establishing, another crime the defendant intended to commit, and (3) a jury instruction that the other crime was one that necessitated further proof of “unlawful means.” It’s a Russian-nesting-doll theory of criminality: The charged crime hinged on the intent to commit another, unspecified crime, which in turn hinged on the actual commission of yet another unspecified offense.

To make matters worse, Judge Merchan instructed the jury: “Although you must conclude unanimously that the defendant conspired to promote or prevent the election of any person to a public office by unlawful means, you need not be unanimous as to what those unlawful means were.”

Due process demands that felony verdicts be unanimous...

There's no doubt this will be overturned on appeal but the Democrats, the courts don't care - they just want to stop Trump from winning the presidency, and  this gives them their sound bites and political ad fodder. Ironically, it looks like it is going to work in Trump's favor, to the detriment of Let's Go Brandon or whomever else the Democrats will try to foist upon America in his place.

Megyn Kelly caught something on the lack of due process

This is just one of many reasons Trump will eventually not be convicted in New York. Kudos to Megyn Kelly for catching it and for her willingness to back Trump even after their own rocky history.

Trump NY trial; my take

My assumption about the New York Trump trial has been that in the big picture (macro) view, it doesn't matter.  To elaborate, if he is convicted, it is at best only going to make a minor difference with voters; some will switch their support away from Trump, and more or fewer will switch their vote towards Trump but most of it has already been baked in to voters' minds. As for the criminality, there will be an appeal process where it will ultimately get overturned. The prosecutors and judge must know that too, given their bold disregard for due process in the trial; this was always only about aiding the election chances of Let's Go Brandon.  Conversely if Trump is acquitted in this initial stage, there will be virtually no impact on the vote. Same if there is a hung jury.  There will be no retrial, before or after the election; it's pointless no matter who wins the election (with a bit of caveat on that).*

As I said, that has been my assumption.  But as the jury deliberations continue, despite my still held assumptions, I cannot help but get nervous about the outcome of this sham, kangaroo court, railroading of Donald Trump for political malfeasance.  Stories like this one do not help with my nervousness:

I realize there are a lot of other takes out there both towards acquittal/hung jury and guilty verdict. I've taken all of them with a grain of salt, since they are opinion driven takes. For some reason this one made me nervous.

*If Trump somehow loses the election, they may still want to convict him to keep any other outsider from trying to come in an disrupt the establishment. They may want to send a message in that vein.  But Trump will still be acquitted on appeal.

Who are the real racists?

This is how the Democrats think.  This is not how they present themselves, but it is a lie.

Truckers for Trump blowback

Truckers for Trump refusing to drive to New York, is as simple as the Bud Light boycott; they do something stupid, make them pay for it.

Oops! Did she just say that?

New York Attorney General Letitia James, Democrat, just said the judge ruled in her favor before the kangaroo court trail of president Donald Trump even began. WTF?

Democrat elites are done with NY mayor Eric Adams

Clearly New York Mayor Eric Adams has upset the Democrat elites, the FBI has taken his phone and iPad. He's not onboard with Let's Go Brandon's open border policy, but is there anything else going on that we don't know about?

Sanctuary cities, pro-illegal immigration Democrats are reaping what they have sewn, in cities like New York, and it's hard not to laugh at their plight:

President Trump arrest primer

At some point I'll have to discuss my thoughts on the implications of the impending Trump arrest in New York.  I believe there's a lot to discuss about it; motivations, implications and to a lesser extent the technical aspects and likely outcome from a legal perspective.

For now, here are Black Conservative Perspective's take and Tim Pool's take, as they both make some interesting points as well as providing some useful context.

Governor Series: NY - Lee Zeldin

New York is a tough tough road for any Republican, but Lee Zeldin does have a shot at the governorship and he'd be a good governor.  Even a fire hydrant would do a better job than you-know-who.

Meanwhile in NY they've got nothing on Trump

 Via Breaking 911:

Manhattan District Attorney Cy Vance is not expected to charge former President Donald Trump or the Trump Organization with crimes in its first indictment, according to Donald Trump‘s attorney.

“They just said, ‘When this indictment comes down, he won’t be charged,'” Ron Fischetti told Politico. “We asked, ‘Is there anything else?’ They said, ‘No.’ ”

Nothing.  Nada.  Bupkis.  If you are surprised, consider yourself an NPC.

Cuomo's NY nursing home massacre

The left is so convinced there is no more right side Res Publica and they have started turning on their own because to the left, politics is blood sport and the true enemy is anyone who isn't 'me'.  While it is good to watch the left eat itself, it should be a lesson to weak-kneed RINOs like those who voted to impeach Trump for two reasons; (i) it should show you who you are aligned with and how quickly you will be torn to shreds when you are no longer useful to them and (ii) in order for conservatives to fight back against this savage political machine is to harden themselves and do the same, meaning they are coming for you RINOs too.  You have no allies in truth.

Tim Pool savages NY governor Cuomo over killing people in nursing homes over COVID-19.  Yes Cuomo's defense will try to pin this on Trump.  It won't work.  And frankly, it's good to see Cuomo twist in the wind for what he did.

Midterms Matter: In New York 11th District, please support Daniel Donovan

Republican incumbent Daniel Donovan in New York's 11th District as of late October was holding onto a slim lead over his Democrat opponent that was just outside the poll's margin of error.  In other words, this looks like a close race.  If you are a conservative, common sense, America first voter on Staten Island, please support Dan Donovan for congress.

America needs more of this:

and more of this

Midterms Matter: In NY 1st District, please support Lee Zeldin

NY's first district barely went for president Obama in 2012, but in 2016 they supported president Trump by 12 points.  Incumbent Lee Zeldin appears to hold an 8 point lead over his Democrat challenger.  But there's no room for complacency if you support the Republican and/or his positions.

Here's why you should go out and vote for him:

For more information check out his website. Please support him in the next 5 days - donate, volunteer, and ensure you vote.

Thank you.
