Sotomayor - Could be worse?

Word is President Obama is going to nominate Justice Sotomayor for the Souter vacancy on the Supreme Court. She's been described as a moderate. So it could be worse - she could be a far left liberal.

Forget for the moment that Souter timed his departure to suit a liberal President and get a liberal replacement.

Forget for the moment that the name is being floated to further Obama's identity politics approach rather than having the best person for the job.

Forget for the moment that justices, even some supposedly conservative ones seem to drift leftward once on they have made it onto the bench.

Forget that while they claim she's a moderate, she's got the seeds of judicial activism in her.

Forget that there are claims she's 'not that smart and a bit of a bully'.

Forget the fact that President Obama has previously stated that he felt the Warren court didn't go far enough;

Barack Obama revealed his long-term goals in a radio interview on Chicago's WBEZ-FM in 2001. Asked about the Earl Warren court decisions that started long lines of activist decisions in many areas, Obama argued that the Warren court didn't go far enough: The Warren court changed the laws, but failed to address the economic issues to bring about "redistributive change."

Obama complained that "the Supreme Court never ventured into the issues of redistribution of wealth" or "economic justice" and failed to "break free from the essential constraints that were placed by the Founding Fathers in the Constitution." The stimulus plan is designed to break through those constitutional restraints on government action.

Just forget all that. Everyone in the media says she's a moderate, so she must be one. Everything is going to be just fine. Drink your soma, it's a Brave New World.
